Perillo Hill Wins Land Use Appeal

Perillo Hill LLP, representing the Village of East Hampton, obtained a victory at the Appellate Division, Second Department, in Matter of Hamptons Residence LLC v. Village, an Article 78 proceeding brought to challenge the Village Zoning Board’s determination of an application for certain variances involving a Coastal Erosion Hazard Area. The proceeding, seeking to annul and reverse the Board’s decision, was denied and dismissed by the Supreme Court. Following briefing and oral argument, the Appellate Division affirmed the dismissal and separately upheld the Board’s determination for the reasons argued by the Firm.
