Perillo Hill Prevails in Federal Appeal - Second Circuit Affirms Dismissal of Section 1983 Action

In Grand Medford v. Town of Brookhaven, the Firm had successfully moved in the District Court to dismiss what was a potentially complex, wide-ranging Section 1983 action asserting due process, equal protection, and First Amendment claims, among others, arising out of development of property and performance bonds. The action was dismissed on the strength of PH’s motion made prior to discovery. Thereafter, Plaintiff took an appeal to the United States Court of Appeals for the Second Circuit. The Second Circuit undertook a de novo review and again affirmed the dismissal on the basis of PH’s arguments. PH Partner Timothy Hill drafted and argued the appeal.
