Perillo Hill Prevails in Federal Action

Perillo Hill LLP, representing the Town of Brookhaven, succeeded in delivering an expedient and efficient victory in the recently decided matter (Kincade Enterprises LLC v. Town of Brookhaven) brought in the Eastern District of New York. The federal action attempted to assert civil rights claims against the Firm’s client under 42 USC 1983 for alleged due process violations and unconstitutional takings. PH immediately initiated proceedings to have the action dismissed and, following a conference that allowed the plaintiff to amend the complaint, promptly sought dismissal of the amended pleading as it failed to cure the deficiencies the firm had identified. The court dismissed the action by Order dated September 18, 2025.
