Perillo Hill Wins Appeal - Article 78 Zoning

Matter of Azia v. Town of Shelter Island Zoning Board of Appeals. Perillo Hill defended this Article 78 challenge to its determination that granted partial (and thus not all of the requested) relief to an applicant in compliance with, among other things, the statutory directive to grant the minimum variance necessary. PH prevailed in the lower court and the proceeding was dismissed. On appeal, the Appellate Division, Second Department, affirmed the dismissal.
