Perillo Hill Prevails in Federal Court: New York Law Journal Decision of Interest
Mercedes v. Restaurant Management Inc. SDNY. Perillo Hill represented the defendant in this matter brought pursuant to the Americans with Disabilities Act (ADA), alleging that our client’s website was not ADA compliant. Recognizing the action as one of a high volume of suits brought by the same firm, and often by the same plaintiff, Perillo Hill moved to dismiss the complaint on the ground that plaintiff lacked standing. The motion was granted and the case dismissed. While these cases often settle for fear of exposure to an award of attorneys’ fees, in the right case, an immediate dispositive motion is the proper, and most efficient and effective, defense. That was the case here.
