SCOTUS Grants Stay Applications Supported By Perillo Hill Briefs in Consequential NY Redistricting Matter
On February 13, 2026, the U.S. Supreme Court granted two related emergency stay applications made in response to a state court ruling that had directed the redrawing of New York’s congressional map on the basis that one congressional district violated state law. Perillo Hill, on behalf of its clients, five members of the New York State Independent Redistricting Commission (IRC), submitted briefs in support of the applications arguing, inter alia, that the state court’s order directing the IRC to redraw the map would have violated federal law; namely, the Equal Protection Clause of the U.S. Constitution.
