Perillo Hill Secures Victory for Public Library
Perillo Hill brought an Article 78 proceeding on behalf of its client, the Union Vale Public Library, seeking mandamus relief requiring, among other things, the Town of Union Vale to comply with the mandatory directives of Section 259 of the Education Law and transfer and pay over to the Library public monies that had been collected for library purposes. The Town failed to make such transfers upon the Library’s written demand and the proceeding ensued. Following a motion to dismiss that PH opposed and defeated, the court issued a Decision and Order granting PH’s Petition on the merits in its entirety and ordering the Town to make the required payments (three years worth).
